Slip and fall accidents may sound insignificant, but a serious fall due to an obstruction or negligent caretaking can have lasting repercussions. Medical expenses may be high, and the injury could even require you to take time off work, costing you valuable wages. If you slip and fall on someone else’s property and you are seriously injured, it is important to remember the steps to take so you are not disadvantaged in the weeks or months to follow.
A Cedar Rapids personal-injury lawyer can evaluate your case and apply local legal insight to offer an assessment regarding the best way to proceed. At Eells & Tronvold Law Offices, PLC, we have more than 75 years of combined experience practicing law, and we will use our expertise to analyze your case and determine if you have a legitimate claim. Call us today at 319-393-1020 to schedule an appointment to discuss your situation, and read on for five steps to take if you slip and fall on someone else’s property.
1. Visit a Doctor
You may be tempted to wait and see how serious your injuries are, but experts at the United States Department of Labor suggest that slips and trips can be serious, and they can even be fatal. Research claims that slips and falls cause 15 percent of all accidental deaths in America.
2. Gather Evidence
It is important that you gather as much information about the location where you fell as possible. Photographs are particularly important, and they can make the difference between a successful and an unsuccessful claim. Take photographs of the obstacle or hazard that caused you to fall before anyone interferes with the scene.
According to the National Floor Safety Institute, 85 percent of worker’s compensation claims are from employees who slip on slick floors. While this may not be easy to photograph, it is still important to record the location in the form of a photograph for future investigations.
3. Find Witnesses
If you fell in a public place, there is a good chance someone witnessed your fall. Get the contact details of any witnesses, including names and addresses, and ask them for any additional information that you might have missed.
4. File a Report
It is important that you record your fall with managers, supervisors or security officers if the fall happened on commercial property. If any emergency officials or police attended to the scene, get a report from them as well.
5. Keep All Medical Records
Keep all medical bills and records. You may be eligible for compensation for these injuries, and it will be easier to claim if you have all of the necessary medical paperwork.
If you slip and fall on someone else’s property, give a qualified Cedar Rapids accident attorney a call. At Eells & Tronvold Law Offices, PLC, we will evaluate your claim and establish if it can stand up in court. Call us today at 319-393-1020 to schedule a free consultation.

Iowa Train Accident May Have Caused Extensive Environmental Damage
CBS News reports that a train that derailed in Iowa may have caused extensive damage to the surrounding environment. Officials claim it is not yet clear how much ethanol leaked into the nearby Mississippi river when the train left the tracks. They are currently working with experts to monitor the environmental impact of the crash, which includes examining the amount of ethanol and fuel that may have escaped from the wreck.
According to rail officials, the train left the tracks in a remote section of its route early one morning. In the accident, 14 cars carrying ethanol derailed, and eight of them were leaking. Various authorities are setting up monitoring stations downriver to ensure they can identify any potential environmental issues as they arise.
Three cars also caught fire in the crash, and another three fell into the river. Emergency workers extinguished the fires, and there were no serious injuries reported.

The large crash closed the road for several hours as officials rushed to the aid of the injured and cleared the wreckage. All lanes reopened approximately 3 hours after the incident. Recent Accidents Highlight Danger of Icy Roads in Iowa
The roads can be especially dangerous in the wintertime. Not only are most drivers unaccustomed to driving in snowy or icy conditions, but the weather also reduces visibility significantly. exercise caution.

Icy Roads Cause Multiple Crashes in Iowa
According to KWWL, sheriff’s deputies claim icy conditions are the cause of multiple crashes across the state. Earlier this month, a one-car crash occurred just after 7 a.m. in the morning. A 36-year-old man was driving a 2004 Dodge Durango when he lost control of the vehicle presumably due to icy conditions.
According to police, the vehicle rolled several times before coming to a stop in the middle of the road. Responders took the driver to a local hospital where medical staff treated him for non-life threatening injuries. Police say the driver was wearing his seatbelt at the time of the crash.
CBS2IOWA reports on another icy crash that occurred earlier this month, which injured one. According to police, the crash occurred shortly after 1 in the afternoon at the intersection of Fox Meadow Drive southeast and East Post Road. A 25-year-old man was driving south when he lost control of his vehicle and crossed over the center line of the road, hitting another vehicle heading north.
Neither driver sustained serious injuries, but responders had to take a passenger in the 25-year-old’s car to the hospital. Medical staff treated the passenger for non-life threatening injuries. Police are still investigating the crash.
Semi-Trailer Truck Crash Sends Two to Hospital, Closes Highway
KCRG9 reports on a collision between two semi-trailer trucks that occurred late last month on Highway 13. According to police, the crash occurred at around 2 in the morning. A 63-year-old man driving a semi rear-ended another semi that a 62-year-old was driving.
Police say the man who caused the accident failed to see that the semi in front of him was pulling to the side, and he did not decelerate fast enough. Responders took both drivers to Mercy Medical Center in Cedar Rapids, where medical staff treated them for non-life threatening injuries. Police had to close the northbound right lane to clean the crash, but they were able to reopen it the following day.

Iowa Crash Fatalities up From 2013
Though fatal crashes in Iowa were more common in 2014 than they were in 2013, the numbers demonstrate a general downward trend from 2001. State officials claim that 319 people died on Iowa roads in 2014, which is more than the 317 victims in 2013. However, those numbers are down nearly 30 percent from 2001, when 446 people died on state and federal roads across Iowa.
The National Center for Statistics and Analysis surveyed Americans to gauge just how safe they were on the roads. Researchers found that 87 percent of respondents claimed to use seatbelts in 2013. That represents a 27-percent increase from the number of people who said they wore seatbelts in 1995.
Police Identify the Victim of a Fatal Crash
KCRG reports on a fatal car accident that left one man dead. According to police, the 27-year-old victim was heading eastbound on U.S. Highway 20 when his vehicle veered off the road and into a ditch. The car rolled before coming to a stop.
The accident occurred at night, and passersby did not spot it nor report it until 11 a.m. the following morning. Police are still investigating the cause of the single-vehicle crash.
Elderly Woman Dies After Crash
According to KCRG, an 84-year-old woman died from injuries she sustained in a car accident late last month. Police claim the woman was traveling west on Highway 62 early one afternoon when she lost control of her vehicle. She veered off of the road and into the ditch, where the car hit an embankment and rolled several times before coming to a stop on its side.
Rescuers were able to remove the woman from the wreckage, and they transported her to a local hospital, where she later died from her injuries. Police are still investigating the crash.
Though Americans are generally safer now than they were just one decade ago, accidents can and do still occur. Defensive driving is still the most effective way to avoid accidents, but some crashes are unavoidable. Woman Injured Man and Totaled His Car Before Fleeing the Scene
In early November, the victim was driving just before midnight when he reached an intersection in downtown Cedar Rapids. He decelerated and stopped at the yellow light, and that’s when another driver struck his vehicle from behind, pushing him into the intersection. According to police, the driver, who was a young woman in her late 20s, got out of her car and approached the man, asking if he was okay.
He told her that he wasn’t and said he needed help. The victim claims the woman then fled the scene, leaving him with a totaled car. He has a history of scoliosis, so he went to the hospital to ensure everything was in order, and medical staff released him a few hours later; however, the man’s pain worsened in the weeks that followed.
The accident victim visited his doctor and learned that he had fractured his spine and would need major surgery. He is now bedridden at a local hospital, facing extensive rehab, not to mention uncertainly regarding a full recovery. The police are still investigating the crash and urge anyone with information to contact them.
Rollover Crash Injures Two
According to KCRG, a car was heading west on Highway 30 late last week when it crashed, resulting in a rollover. Responders took two people involved to a local hospital, one with serious injuries. Fatal Crash Occurred During a Statewide Blizzard Warning
According to court records, a multi-vehicle crash that has now resulted in a wrongful death lawsuit occurred on Dec. 20, when there was a statewide blizzard warning. Two semi-tractor trailer drivers allegedly lost control of their vehicles, which proceeded to block traffic on Interstate 35. The lawsuit contends that a third vehicle carrying a woman and several children crashed into one of the semis before the driver could brake on time.
The driver got out and was trying to move his children to safety when a third tractor-trailer lost control at the scene, crushing the man’s vehicle—with his fiancée still in it—against one of the other trucks. Court records state 15 vehicles in total were involved in the accident. The woman in the first car died, as did a pregnant woman who was later involved in the crash site, when she got out of her own car to check on her son in the backseat.
The first man, whose fiancée died in the crash, is suing the truck drivers, as well as the companies that employed them. The wrongful death lawsuit claims that State Patrol determined all of the vehicles in the initial crash were not traveling at safe speeds consistent with road conditions at the time of the accident.
Iowa Family Believes Their Relative Was a Victim of Faulty Airbags
According to KCRG, a family in Cedar Rapids is incredibly interested in the current airbag recall debate, because they believe their relative’s death in 2003 could be linked to the defective airbags. Many believe the airbags in question expand with too much force when they deploy during an accident. Takata, the manufacturer, missed a deadline that the National Highway Traffic Safety Administration issued regarding expanding the voluntary recall from states with high humidity nationwide, and they had to attend yet another hearing in D.C. earlier this week.
Honda officials have decided they are not going to wait for the supplier to issue the recall, and they are launching a national recall of all Honda vehicles that have the suspected airbags. There have been dozens of injuries and at least five deaths linked to the allegedly defective airbags.

According to KCRG, the Iowa State Patrol has confirmed that two people have died and a third was injured in a single-vehicle crash. Troopers reported that a 58-year-old woman was driving a Chevrolet Silverado on Highway 65 when she lost control of the truck and rolled it into a ditch. At the time, there was also a 43-year-old passenger in the front seat, and responders reported her and the driver dead at the scene. They also rushed a second passenger, a 16-year-old boy with serious injuries, to a local hospital.
Cedar Rapids Police Come Upon a Crash, Results in Arrest for One of the Drivers
KWWL reports on a crash that occurred earlier this month and resulted in an arrest for one of the drivers involved. According to the news source, police came upon the crash and eventually had to chase down one of the drivers. Officers were performing standard patrols near Wilson Avenue and Kenrich Drive SW when they saw two vehicles collide.
One of the drivers ran from the scene, but officers were able to catch him a short while later. Police arrested the 21-year-old man and charged him with interference with official acts that caused injury. He was also arrested on a warrant that was outstanding for a probation violation, as well as warrants for willful injury, first-degree robbery, fifth-degree theft and assault while participating in a felony.
Police are still investigating the accident. They say that further charges may be filed against the driver who fled.

That means there is approximately one preventable death on U.S. roads every 51 minutes.

The couple was heading south through the intersection on a county road when a truck heading eastbound struck the minivan, spinning it into the path of another truck. Responders pronounced both the man and his wife dead at the scene. The truckers were not injured, and police are still investigating the accident.
Collision Sends Two to Hospital
KWWL reports on a collision that occurred late last week at the intersection of 16th Avenue and 80th Street SW in Cedar Rapids. According to police, a 50-year-old man who was driving a GMC Sierra truck and heading northbound pulled into the intersection when an 86-year-old man driving a Buick Regal heading westbound struck him. According to KCRG, the Iowa State Patrol responded to an accident scene earlier this month to find the remnants of a rollover crash. Police found the 27-year-old driver after he had failed to navigate a turn safely and rolled into a ditch instead.
Authorities claim the vehicle rolled over twice before striking a telephone pole and coming to a stop. The driver was not wearing a seatbelt at the time, and responders pronounced him dead at the scene.

3 Important Facts About Medical Malpractice
There are many problems with the United States healthcare system, and these issues lead to a high number of medical-malpractice incidents. Malpractice insurance companies are partially to blame because they work hard to pay out as little as possible to victims of negligent doctors. Unfortunately, these companies are highly successful; they profit twice as much each year as insurance agencies in other industries.
Negligent hospital administrations are also to blame. According to The Center for Justice & Democracy, many hospitals fail to adapt to new hazards until an accident occurs in their facility. Some of these accidents result from malfunctioning equipment that should have been replaced or repaired well before an injury occurred.
If you are a victim of malpractice in Cedar Rapids, we can help you seek the compensation you need to recover from your injuries. At Eells & Tronvold Law Offices, PLC, we have 75 years of combined experience practicing law, and we are committed to standing up for victims. 1. Medical Boards Allow Reckless Doctors to Continue Practicing
State Medical Boards are in charge of identifying dangerous doctors and revoking their medical licenses. Unfortunately, these boards aren’t always as active as they should be.
CBS News reports that many doctors who are still practicing have extensive histories of wrongdoing. Some doctors in the United States have paid out in more than 25 malpractice lawsuits without losing their licenses. The problem is so widespread that many hospitals are revoking these doctors’ privileges before the medical board even issues a warning.
2. Slow Diagnoses May Be Considered Malpractice
Not all malpractice cases involve faulty medical equipment or non-sterile operating rooms. In fact, the most visible malpractice cases don’t often represent common types of negligence. Doctors have a duty to recognize diseases and conditions if they are reasonably obvious from a medical standpoint, and they must also be quick to order the tests necessary to confirm a diagnosis. That is because early treatment can mean the difference between a full recovery and a terminal prognosis.
Cincinnati.com reports that a jury recently ruled in a patient’s favor after her doctor failed to identify that she was suffering from a perforated bowel. The problem grew worse without the necessary treatment, and now, she has chronic disabilities.
3. Medical Malpractice Is a Complicated Field
In the world of personal-injury law, medical malpractice is one of the most complex areas. It involves extensive investigations, expert testimony and a thorough understanding of scientific data.
Not every personal-injury lawyer has the necessary skill set to properly represent victims, and it is important to look for a lawyer with a successful case history. If you are seeking an attorney to help you find justice through a medical-malpractice lawsuit, we can help. We have the experience and knowledge necessary to stand up to large insurance companies. Distracted Truck Driver Crashes Into School Bus
When it comes to car accidents, weight is what determines each driver’s survival rate. The physics are simple: The heavier a vehicle is, the more damage it will cause to smaller vehicles. Of course, this idea is most easily seen in crashes between tractor trailers and small cars. A truck with a full load is 20 times heavier than the average passenger car. However, even small differences in weight can increase the risk of a fatality.
The National Highway Traffic Safety Administration conducted a study on the relationship between vehicle weight and fatality risk. The agency surveyed thousands of accidents between cars and small pickup trucks. Researchers determined that 80 percent of people who died in the accidents were occupants in the smaller vehicle. Given that information, a group of school children are fortunate to be alive after a tractor trailer struck their bus.
Most full-sized school buses weigh approximately 28,000 pounds, whereas any given tractor-trailer will weigh 80,000 pounds. Last week, a truck rear-ended a school bus. The bus was carrying more than a dozen children at the time.
Witnesses Say the Circumstances Surrounding the Accident Were Bizarre
According to FOX News, witnesses suspect the truck driver of being distracted. They say that the male driver was carrying a female passenger in his cab, and she was not wearing any clothes during the accident. Furthermore, investigators determined that the truck driver did not even press his brakes before colliding with the bus, possibly indicating that he did not see the vehicle. Paramedics took 10 of the children to the hospital with varying degrees of injury. Officers say that the accident would have been much worse had the bus driver not seen the truck and sped up at the last moment before the impact.
If you’ve been involved in a car accident with a distracted driver, you are likely looking for justice. At Eells & Tronvold Law Offices, PLC in Cedar Rapids, we are proud to help our clients as they seek compensation through personal-injury lawsuits. To speak with a truck-accident lawyer about your crash, please call 319-393-1020.
Another Bus-Truck Accident Ended in Tragedy
The NY Post reports that the occupants of another bus were not as lucky as the children. Police say that a tractor trailer veered into oncoming traffic and struck a bus carrying a college softball team. The collision sent more than a dozen people to the hospital, and four members of the softball team died from their injuries. Police are not sure what caused the truck driver to leave his lane, but they have drawn his blood to test for intoxication.
Negligent driving takes many forms. If you have been injured by a driver who was distracted, impaired or reckless, we can help. Family Sues Airline After Plane Crashed Into Home
Like other types of personal-injury claims, wrongful-death lawsuits can arise out of many different situations. Specifically, there are three circumstances that cause lawsuits more than any others: car accidents, medical malpractice and defective consumer products. These are the most common sources of wrongful-death lawsuits.
Successful wrongful-death lawsuits generally have at least one factor in common: They involve negligent or reckless behavior that leads to a fatality. Of course, there are many deaths that follow less common situations.
For instance, not many lawsuits include a plane crashing into a home. That’s what happened in 2009 when a plane flying a connecting flight crashed into a house, killing many of the passengers on the flight, as well as one of the residents in the home.
An investigation revealed that pilot error was the primary cause of the accident, and most of the families of those who died in the accident filed wrongful-death lawsuits during the past five years. Over time, the airline settled all but one of the lawsuits out of court, which is common. In fact, more than 90 percent of all personal-injury lawsuits end in a settlement.
Douglas Wielinski’s Family Decided to Take Their Lawsuit to Trial
The Star Tribune reports that Wielinski was in the home when the crash occurred, and he died at the scene. Meanwhile, his wife and daughter, who were also home, were able to escape before the home burned down.
Both women suffered serious injuries in the incident and continue to suffer from the trauma they survived. In the years since the event, they’ve tried to settle with the insurance company responsible for the airline, but the insurer may have attempted to settle for a low amount.
If you are looking for a personal-injury lawyer to help you find justice after the death of your loved one, let us help. At Eells & Tronvold Law Offices, PLC, you can rely on our 75 years of experience as you seek fair compensation for a negligent accident. We will guide you through the process with compassion and professionalism. To learn more about our services, please call 319-393-1020.
The Insurance Company Refuses to Compensate the Family for Certain Valuables
Wielinski spent his life building an impressive baseball card collection. Several years ago, he sold a small portion of the collection for $325,000. Even so, the insurance company refused to pay the family for the value of the remaining cards. WIVB News reports that this was one of the major reasons why the family chose not to settle. Other reasons include the fact that the insurance company maintains Wielenski didn’t suffer, despite the fact that the evidence proves otherwise.
If you believe that another party’s negligence was the primary cause of your loved one’s death, we can help you seek the compensation you need to pay for medical bills, lost wages and funeral expenses. To arrange a consultation with a personal-injury lawyer in Cedar Rapids, please call 319-393-1020.
